1. Provider and scope
These terms apply to services supplied by Karl Heinz, Einzelunternehmer (sole proprietor) trading as Property 360 Tour, Hollander Strasse 57, 30629 Hannover, Deutschland. Email: hello@property360tour.com.
These terms apply only to business customers, including professional vacation-rental owners, operators, managers and agencies acting for a business. Property 360 Tour does not accept consumer orders through this website. The person submitting an order confirms that they act for business purposes and have authority to bind the named business.
2. Services and prices
The public B2B launch offers are a Cinematic Property Video at USD 50 and an Interactive Digital Tour at USD 100. A first eligible business order may receive the displayed 10% reduction, resulting in USD 45 or USD 90. Selecting both services for the same approved property may receive the displayed 25% bundle reduction, resulting in USD 37.50 plus USD 75. Each service includes one consolidated revision and no monthly subscription. These are final prices. No VAT is charged or shown under Section 19 UStG (Kleinunternehmerregelung).
3. Enquiries and contract formation
Submitting the website form creates a non-binding order request and does not charge the customer. A contract is formed only when Property 360 Tour accepts the project in writing and the customer accepts the confirmed scope and price or completes the requested payment authorization.
4. Customer material and permissions
The customer must provide sufficient approved property images and confirms that all supplied photographs, logos, texts, floor plans and links may be used for the project. The customer grants the limited rights required to review, process, store, reproduce and adapt that material for production and delivery. Work may be placed on hold if rights, consent or source quality cannot be confirmed.
5. Production and visual accuracy
The service is created from the supplied or approved material using efficient digital production tools. Results are marketing presentations, not measured architectural scans. We preserve known rooms and fixed architectural features as the visual reference, but exact dimensions, geometry or commercial performance are not guaranteed.
6. Preview, revision and approval
A private preview is provided for review. One consolidated revision round is included. New image sets, a changed property, a materially changed brief or additional versions may require a separate agreement. The customer should report reproducible technical defects without undue delay and allow a reasonable opportunity to correct them.
7. Deferred Stripe payment
A private Stripe link may be issued after the preview is ready. Stripe first authorizes the agreed USD amount without completing the charge. Property 360 Tour may capture the authorization only after the final unwatermarked deliverables have passed quality review and are ready for immediate release. A bundle may use separate, clearly identified authorizations for its two services. Payment is complete only after server-side capture confirmation.
8. Delivery and usage rights
After full payment, the customer receives a non-exclusive, worldwide right to use the final approved deliverables to market the property or business identified in the order. Source files, production templates and reusable software components are not included unless expressly agreed. Public portfolio use by Property 360 Tour requires separate permission.
9. Customer delay and third-party platforms
Delivery dates are estimates unless expressly confirmed as binding. Missing material, delayed feedback, platform outages or events outside reasonable control may extend delivery. We are not responsible for later changes, rejection or availability rules imposed by third-party websites or social platforms.
10. Liability
Liability is unlimited for intent, gross negligence, injury to life, body or health, fraudulent concealment and mandatory statutory liability. For ordinary negligence affecting an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract. Mandatory statutory rights remain unaffected.
11. Business cancellation and refunds
There is no consumer withdrawal right because orders are accepted only from business customers. Before production begins, the customer may request cancellation. After production begins, cancellation charges and any voluntary refund are assessed against completed work and non-recoverable third-party costs. The detailed business cancellation and refund policy forms part of these terms. Mandatory rights for defective performance remain unaffected.
12. U.S. market, governing law and disputes
The services and prices are prepared for U.S. vacation-rental businesses. Applicable mandatory U.S. federal, state and local law remains unaffected where it legally applies. Property 360 Tour is nevertheless operated by a sole proprietor established in Germany. Because no specific U.S. state has yet been selected and verified as the contractual governing law, German law applies to the contract, excluding the UN Convention on Contracts for the International Sale of Goods. A different U.S. state law applies only if the written order confirmation expressly names that state and the clause is legally reviewed and enforceable.
Before filing a claim, each party should give the other written notice and allow 30 days for a good-faith business resolution, unless urgent relief is required. Where legally permitted for business customers, the place of jurisdiction is Hannover, Germany. Property 360 Tour is neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board; consumer contracts are not accepted.
13. Entire agreement and priority
The written order confirmation, these terms and the accepted project brief form the agreement. The order confirmation prevails over these terms for an expressly identified conflict. Any customer purchasing terms apply only if Property 360 Tour accepts them in writing.
